Introduction
Thank you, for choosing to place an order for a Pembleton .
Each Pembleton is a handcrafted, low-volume vehicle built to order. As such, the purchase process, build timeline, and ownership experience differ from mass-produced vehicles. These terms are designed to clearly set expectations and ensure a fair and transparent agreement for both parties.
1. Payment
1.1
Any vehicle or product remains the property of Pembleton Motor Company until full payment has been made and cleared. Pembleton Motor Company reserves the right to retain possession of any vehicle or product until full payment has been received, including beyond any agreed delivery or collection date.
1.2
The deposit (currently £5,000) becomes non-refundable after 30 days from receipt of funds, or upon the first staged payment being made (whichever comes first). This reflects the commencement of production planning, parts sourcing, and administrative costs incurred.
The start of vehicle assembly is defined as the date of the first staged payment.
1.3
The stated price on the invoice does not include delivery of the vehicle. Vehicles must be collected from Pembleton Motor Company unless otherwise agreed in writing.
1.4
Payments will be taken as follows:
- £5,000 deposit upon ordering
- Three further staged payments (remaining balance including extras, divided into three equal amounts)
- First staged payment due on build start date
- Second staged payment due halfway through the build
- Final payment due one week before collection
Any rounding differences and additional extras added after initial pricing will be included in the final payment, or billed separately and due no later than one week before collection
1.5
Payment dates will be confirmed following submission of the options list or can be provided earlier upon request.
1.6
The final payment must be received at least 5 working days prior to collection of the vehicle.
1.7
Ownership of the vehicle transfers to the customer once full payment has been received and cleared.
1.8
Options lists submitted within 30 days of deposit are priced according to the price list valid at the deposit date.
Options lists submitted or amended after this period will be priced according to the current price list at the time of submission (excluding base vehicle price), are subject to supplier availability, and may incur additional costs or may not be possible.
1.9
Any order cancelled within 30 days of placing the deposit will be subject to a £500 cancellation fee (including VAT), reflecting administrative and processing costs.
1.10
Upon approval of final estimates for production, the vehicle specification is deemed final. Any requested changes after this point:
- Are at the sole discretion of Pembleton Motor Company
- Will incur a minimum administration fee of £75 (inc. VAT)
- May include additional costs for parts, labour, or supplier commitments
Due to production scheduling and bespoke components, some changes may not be possible. Once build has commenced, no further specification changes can be accepted.
2. Warranty
2.1
A 12-month warranty (or 5,000 miles, whichever comes first) is provided from the date of handover, covering mechanical part failures under normal road use.
This excludes failures resulting from:
- Motorsport or competitive use (track days, rallies, hill climbs, etc.)
- Driving styles not suitable for public road use
2.2
The warranty does not cover normal wear and tear, including but not limited to tyres, clutch components, and batteries.
2.3
The warranty does not cover accidental damage such as dents, scratches, or external damage.
2.4
The powder-coated chassis and all other power-coated parts are covered under warranty as per clause 2.1.
2.5
Paint finishes are covered for a period of 12 months from handover against defects in materials or workmanship. This does not include damage caused by stone chips, environmental conditions, wear and tear, or insufficient care and maintenance. Any such defects must be reported immediately.
2.6
The chassis must be treated with a suitable protective product (e.g. Waxoyl) and maintained appropriately, including cleaning after exposure to corrosive conditions such as salted roads.
Wheels and underbody components should also be suitably protected. Failure to take reasonable maintenance steps may void warranty claims.
2.7
Pembleton Motor Company reserves the right to replace any faulty parts with alternatives of equivalent specification and retain ownership of replaced parts.
2.8
All warranty work is to be carried out by Pembleton Motor Company.
All labour and parts are covered when warranty work is undertaken by Pembleton Motor Company.
Where required, the customer is responsible for arranging and covering transport to and from Pembleton Motor Company. A collection/delivery service may be available at additional cost.
2.9
Significant modifications to the vehicle (e.g. suspension changes, engine remapping) may void the warranty where such modifications contribute to part failure.
2.10
Warranty applies only to manufacturing defects and excludes damage caused by:
- Environmental factors
- Improper maintenance
- Misuse or neglect
2.11
Bodywork is not included within the warranty. Pembleton Motor Company may offer repair services at additional cost but is not obligated to do so.
2.12
Any faults must be reported immediately. Failure to do so may:
- Increase risk of further damage
- Void warranty claims
2.13
Failure to follow maintenance guidelines in the owner's manual may void warranty claims.
2.14
Pembleton Motor Company reserves the right to determine appropriate repair methods and materials.
2.15
Where a vehicle cannot reasonably be returned to Pembleton Motor Company, replacement parts for approved warranty claims will be supplied. Pembleton Motor Company reserves the right to request return of faulty parts.
3. First Service
3.1
A labour-free first service is available at 1,000 miles and should be completed within 12 months of handover.
This service is only available when carried out by Pembleton Motor Company. The service includes:
- Engine and gearbox oil and filter changes
- Clutch adjustment
- General inspection and checks
Parts and consumables are not included and will be charged to the customer.
If this service is carried out by an approved servicing provider or third party, standard labour charges will apply and the labour-free service will not be applicable.
4. Completion of Vehicle
4.1
Completion may be delayed due to registration processes (DVLA). The vehicle will be completed with an IVA certificate prior to registration.
4.2
Handover dates are indicative and may be subject to change. A confirmed date will be provided once all documentation is complete.
4.3
Vehicles must be collected unless otherwise agreed in writing.
4.4 (Force Majeure)
Pembleton Motor Company shall not be liable for delays caused by events outside its reasonable control, including but not limited to supplier delays, material shortages, transport issues, or regulatory delays.
4.5 (Risk Transfer)
Risk in the vehicle passes to the customer upon collection or delivery, whichever occurs first.
5. Non-UK Sales
5.1
Vehicles may be supplied with UK registration or unregistered, at the customer's choice.
5.2
All sales to non-UK countries will be supplied with either a UK IVA test certificate and registration (with V5C registration document), or no registration or test certificate. This is the choice of the customer.
5.3
Headlight lenses can be swapped for LHD versions on request at no extra fee. This will be a LHD version of the standard lens used on all UK RHD T24s. Vehicles will be fitted with standard RHD lenses unless otherwise requested by the customer.
5.4
Speedometers can be swapped to KM/H on request at no extra fee. Vehicles will be fitted with standard MPH speedometers unless otherwise requested by the customer.
5.5
There may be a fee for a left-hand drive chassis. The applicable amount will be detailed on the invoice.
5.6
The customer is fully responsible for:
- Registering the vehicle in their country
- Ensuring compliance with local regulations
- Any import duties, taxes, or associated costs
5.7
Pembleton Motor Company cannot advise on international registration processes and will supply vehicles built to a standard suitable for UK IVA requirements unless otherwise agreed.
5.8
All warranty terms outlined in Section 2 apply to non-UK sales.
5.9
Postage and shipping costs for any warranty parts supplied internationally are the responsibility of the customer.
5.10
Deposits for left-hand drive chassis are non-refundable.
6. Approved Servicing Providers
6.1
Warranty work carried out by Pembleton Motor Company is covered in full (parts and labour).
6.2
Approved servicing providers may carry out work; however:
- Customers are responsible for labour and associated costs
- Pembleton Motor Company will not contribute to these costs
6.3
Replacement parts for approved warranty claims will be supplied free of charge to approved servicing providers.
7. Limitation of Liability
Pembleton Motor Company shall not be liable for any indirect or consequential losses. Total liability shall not exceed the purchase price of the vehicle.
Nothing in these terms limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence.
8. Entire Agreement
These terms constitute the entire agreement between both parties and supersede any prior discussions or representations.
9. Governing Law
These terms are governed by the laws of England and Wales.
10. Data Protection
Customer information will be processed in accordance with applicable data protection laws and used only for the purpose of fulfilling the order and related services.
11. Photography Consent
By proceeding with your order, you may choose to opt in or out of having your vehicle photographed. Any photographs taken may be used by Pembleton Motor Company for promotional purposes across media channels, including both print and digital platforms.
Participation is entirely voluntary, and your decision will not affect your purchase in any way. Photography, if undertaken, will be carried out without disruption and will not cause any delay to your agreed vehicle delivery date. We are happy to share digital copies of this media with you upon request.
